at the 4-903 settlement conference my ex and his attorney provided me with a "settlement" custody offer. it was a 5-3-2 schedule with no child support. Currently ,I have primary custody and he has liberal visitation. the schedule is so complex, I know that our 2 year old son will have a hard time with it. My ex is extremely abusive to me and threatens to kill me on a regular basis. Custody evaluator seem to not care about his death threats to me since.

my ex and his attorney had the same extact custody schedule that the custody evaluator suggested. I did not receive the settlement offer until 6 weeks later. Could they have had inside information? How did they know this was the schedule.

Should I ask for a different custody evaluation. I cant do this schedule to a 2 year old. It is so disruptive and harmful, and it puts me in and my son in danger.

Great question. I would really recommend you consider going to one of the live events put on by Utah divorce attorney Patricia Latulippe. During these events she really walks people through the divorce process in Utah and addresses issues just like the one you are referring to.

Is it a common practice in Utah for a custody evaluator to refuse input and blow off information from a child's GAL during a custody evaluation and custody battle? I know a recent case where the custody evaluator did just that. Doesn't seem right to me cause that child involved in the dispute had his/her voice and his/her wishes thrown out and not taken into consideration. If that happens how can that be contested so the child's rights can be entered into the case by the GAL and have his/her say in court? The child is 11 y/o in this case.

Great point. I see both sides and see how this could and did cause a problem with ebay users. I think as a seller on ebay you should be able to leave feedback regarding the buyer.
